TERMS & CONDITIONS
I accept my invitation to participate in the GKA Professional Training Program/Pre-Professional Program/Children’s Program/Summer Program. I certify that the information provided in my registration form is complete and accurate. I understand that GKA maintains a policy of non-discrimination with regard to ethnic background, religion, race and sexual orientation.
GKA is not responsible for injuries on premises. I ACKNOWLEDGE, AGREE AND UNDERSTAND THAT: 1) dance and related activities which are part of Gelsey Kirkland Academy of Classical Ballet events, activities, rehearsals and performances require strenuous physical exertion and possible exposure to dangers and risks of bodily injury; 2) the Risks and dangers may be caused by my actions or inactions, the action or inactions of others participating in the Dance Activities, the conditions in which the Dance Activities take place, or the negligence of GKA or its agents and employees; 3) there may be other Risks and social and economic losses either not known to me or not readily foreseeable at this time; and 4) I FULLY ACCEPT AND ASSUME SUCH RISKS AND ALL RESPONSIBILITY FOR LOSSES, COSTS, AND DAMAGES I may incur as a result of my participation in Dance Activities. I HEREBY WAIVE AND RELEASE GKA and its agents and employees from any and all liabilities, claims, costs and expenses of any sort whatsoever which I may at any time have incurred, arising from any injury, sickness or disease occurring to me while participating in Dance Activities.
I hereby grant to Gelsey Kirkland Academy of Classical Ballet (Company), his or her assigns, licensees, successors in interest, legal representatives, and heirs the irrevocable right to use my name (or any fictional name), picture, portrait, video, or photograph in all forms and in all media and in all manners, without any restriction as to changes or alterations (including but not limited to composite or distorted representations or derivative works made in any medium) for advertising, trade, promotion, exhibition, or any other lawful purposes, and I waive any right to inspect or approve the photograph(s) or finished version(s) incorporating the photograph(s), including written copy that may be created and appear in connection therewith. I hereby release and agree to hold harmless the Company, his or her assigns, licensees, successors in interest, legal representatives and heirs from any liability by virtue of any blurring, distortion, alteration, optical illusion, or use in composite form whether intentional or otherwise, that may occur or be produced in the taking of the photographs, or in any processing tending toward the completion of the finished product, unless it can be shown that they and the publication thereof were maliciously caused, produced, and published solely for the purpose of subjecting me to conspicuous ridicule, scandal, reproach, scorn, and indignity. I agree that the Company owns the copyright in these photographs and I hereby waive any claims I may have based on any usage of the photographs or works derived therefrom, including but not limited to claims for either invasion of privacy or libel. I am of full age and competent to sign this release. I agree that this release shall be binding on me, my legal representatives, heirs, and assigns. I have read this release and am fully familiar with its contents.
Tuition & Refund Policy
All fees paid to GKA are non-refundable and all fees are owed to GKA in their entirety regardless of student’s completion of the program. Students, who sustain an injury and/or illness 2 weeks or more prior to the start of the course, may receive a partial refund at the discretion of GKA staff. The student will need to submit (at least two weeks prior to the commencement of the course): 1. A letter explaining the situation, 2. Medical documentation of the injury and/or illness, and 3. A note from their doctor stating the specific diagnosis and that the student cannot participate because of the injury and/or illness. At the discretion of GKA staff, a refund may be provided (minus a $500.00 non-refundable deposit fee). If the student fails to submit the required documentation on time, or they sustain an injury and/or illness less than 2 weeks before, or during, the course, a credit towards any future course of instruction at GKA may be provided at the discretion of GKA staff, that is equal to the value of the remaining time of instruction,
Payment Plan Policy
For GKA’s full academic year programs (Professional Training Program, Pre-Professional Program, Children’s Program), four Payment Plan options are offered. All Payment Plans require a $500 deposit to be made upon registration, with subsequent payments due on set dates throughout the year. If paying by credit card, all subsequent payments will be auto-debited from the credit card provided at registration. All fees paid to GKA are non-refundable and all fees are owed to GKA in their entirety.
Payment Plans with more than two installments incur a surcharge, which is built into the payment amounts. The surcharges are as follows:
0% for Payment Plan in 2 installments ($500 deposit, balance due 9/1)
1.4% for Payment Plan in 3 installments ($500 deposit, subsequent payments due 9/1 and 12/1)
1.8% for Payment Plan in 4 installments ($500 deposit, subsequent payments due 9/1, 12/1 and 2/1)
2.7% for Payment Plan in 9 installments ($500 deposit, subsequent payments due 9/1, 10/1, 11/1, 12/1, 1/1, 2/1, 3/1 and 4/1)
All families selecting a Payment Plan are subject to the following fees:
Late Fee: $50. The Registrar will contact you if your credit card has declined. If the problem is not corrected and we have not received payment by the 15th of the month, a Late Fee of $50 will apply.
Three Strike Policy. If your credit card has declined twice and declines again a third time, you will be removed from your payment plan and payment of the remaining balance will be required immediately.
I HAVE READ THIS AGREEMENT, fully understand its terms, understand that I have given up substantial rights by agreeing to it, have agreed to it freely, and intend it be a complete and unconditional release of all liability to the greatest extent allowed by law, and agree that if any portion of this agreement is held to be invalid, the balance, notwithstanding, shall continue in full force and effect.
Agreement to these Terms and Conditions is required in order to enroll in any GKA program. You must acknowledge acceptance of the Terms and Conditions during the online registration process.
